It is important to note that there are exceptions and specific circumstances in which eviction for non-payment of rent can proceed during the winter months.

For example, if a tenant has a history of consistently not paying rent or if the eviction process was initiated before the freeze period, the eviction may still proceed.

Additionally, the Winter Eviction Freeze does not apply to other types of evictions that are not related to non-payment of rent. For example, if a landlord needs the property for their own use, is conducting necessary repairs or renovations, or has other valid reasons for eviction as outlined in the RTA, these evictions may still proceed during the winter months.

Landlords and tenants in Ontario should be aware of their rights and responsibilities under the RTA and consult with legal professionals or the Landlord and Tenant Board for specific guidance on eviction-related issues, especially during the Winter Eviction Freeze period.
